Cancellation & Refund Policy

This policy explains how Pacific DataBytes handles service cancellations, data-quality concerns, replacement requests, credits and eligible refunds.

Pacific DataBytes, Inc. (“Pacific DataBytes,” “we,” “us,” or “our”) is committed to delivering reliable business data, marketing, technology and software-development services that meet the agreed requirements of our clients.

This Cancellation and Refund Policy explains how cancellation requests, service concerns, data-quality issues, credits, replacements and refund requests are handled.

This policy applies to services purchased directly from Pacific DataBytes unless different terms are specified in a signed proposal, order form, Statement of Work, service agreement, invoice or other written contract.

Where a written agreement contains refund or cancellation terms that differ from this policy, the terms of that agreement will apply.

1. Services Covered by This Policy

This policy may apply to services including:

  • Customized B2B contact databases.
  • List management and data research.
  • Technographic data.
  • MSP and technology-partner data insights.
  • Database cleansing, verification, enrichment and maintenance.
  • Digital marketing and campaign services.
  • Lead-generation and account-based marketing services.
  • Website design and development.
  • Mobile application development.
  • ERP, RPA, AI and machine-learning solutions.
  • Maintenance, support, consulting and related professional services.

Because many of our services are customized, digitally delivered, research-based or developed specifically for a client, refund eligibility depends on the nature of the service, the work completed and the terms agreed before the project begins.

2. Project Cancellation Requests

Clients may request cancellation by contacting their assigned account manager or emailing info@pacificdatabytes.com.

A cancellation request should include:

  • Client or company name.
  • Project or service name.
  • Invoice or order reference.
  • Signed Statement of Work or agreement, where applicable.
  • Reason for cancellation.
  • Supporting information or evidence.
  • Requested cancellation date.

A cancellation request is not considered accepted until Pacific DataBytes confirms it in writing.

3. Cancellation Before Work Begins

When a cancellation request is received before research, development, campaign preparation, data processing, resource allocation or other project work has started, Pacific DataBytes will review the payment for refund eligibility.

Any approved refund may exclude:

  • Non-refundable deposits specified in the agreement.
  • Discovery or consultation work already completed.
  • Administrative or onboarding work already performed.
  • Third-party tools, licences, advertising costs or vendor expenses purchased for the client.
  • Payment-processing or banking charges that cannot be recovered.
  • Other committed costs approved by the client.

4. Cancellation After Work Has Begun

When a project is cancelled after work has started, the client will remain responsible for:

  • Work completed up to the cancellation date.
  • Data research or verification already performed.
  • Development, design, configuration or testing already completed.
  • Resources reserved or allocated to the project.
  • Approved third-party expenses.
  • Deliverables already provided.
  • Other non-cancellable costs incurred for the project.

Where the amount paid exceeds the value of completed work and committed expenses, the unused balance may be eligible for a partial refund or service credit after an internal review.

5. Customized Data Products

Customized databases, contact lists, technographic datasets, market intelligence and other data products are prepared according to client-approved targeting criteria.

These criteria may include:

  • Industry.
  • Geography.
  • Job title.
  • Department.
  • Seniority.
  • Employee size.
  • Revenue range.
  • Technology usage.
  • SIC or NAICS codes.
  • Company type.
  • Other agreed targeting requirements.

Once a customized data product has been researched, compiled, processed or delivered, it is generally not eligible for cancellation or a change-of-mind refund.

Pacific DataBytes will investigate legitimate concerns where the delivered data materially differs from the written specifications agreed in the order, proposal or Statement of Work.

6. Reporting a Data-Quality Issue

Clients should report an alleged data-quality issue as soon as reasonably possible after delivery.

The request should include:

  • Order or invoice reference.
  • Name of the delivered file or campaign.
  • Description of the issue.
  • Sample records demonstrating the concern.
  • Bounce, validation or error reports where relevant.
  • The agreed targeting or quality requirements.
  • Any other evidence reasonably required to investigate the matter.

Pacific DataBytes may verify disputed records using its internal research, validation and quality-control procedures.

A refund or replacement decision will be based on the agreed project specifications and not solely on the client’s campaign response, sales outcome or third-party platform report.

7. Available Remedies

Where an investigation confirms that a service or deliverable materially fails to meet the agreed requirements, Pacific DataBytes may provide one or more of the following remedies:

  • Correction of the affected records.
  • Re-verification of the data.
  • Replacement records.
  • Re-performance of the affected service.
  • Completion of missing deliverables.
  • A service credit.
  • A partial refund.
  • A full refund where the service cannot reasonably be corrected, replaced or completed.

The appropriate remedy will depend on the nature and extent of the issue, the work already completed and the applicable agreement.

Where correction, replacement or re-performance can reasonably resolve the issue, Pacific DataBytes may provide that remedy before considering a monetary refund.

8. Digital Marketing and Lead-Generation Services

Marketing and lead-generation results may be affected by factors outside the control of Pacific DataBytes, including:

  • Market demand.
  • Brand awareness.
  • Client offers and pricing.
  • Email content and subject lines.
  • Domain reputation.
  • Sender configuration.
  • Audience response.
  • Sales-team follow-up.
  • Advertising-platform policies.
  • Third-party algorithms.
  • Economic and industry conditions.

Unless a specific result has been guaranteed in a signed agreement, the absence of a particular number of responses, leads, appointments, conversions or sales does not by itself make a service eligible for a refund.

Refund requests will instead be assessed according to whether Pacific DataBytes delivered the services and work specified in the applicable agreement.

9. Website, Application and Software Projects

Website-development, mobile-application, ERP, RPA, AI, machine-learning and other software projects may involve multiple stages, including discovery, planning, design, development, testing, deployment and support.

Payments for completed or approved project stages are generally non-refundable.

If a project is cancelled before completion:

  • The client will be charged for completed work.
  • Approved milestones and deliverables will remain payable.
  • Committed third-party expenses will be deducted.
  • Any remaining eligible balance will be reviewed for a partial refund or service credit.

Requests based on defects or technical issues will first be handled through reasonable correction, debugging or re-performance, subject to the agreed project scope.

New features, changed requirements, third-party compatibility issues or work outside the approved scope are not considered defects and may require a separate quotation.

10. Recurring and Subscription Services

A client may request cancellation of a recurring service according to the notice requirements stated in the relevant agreement or order.

Cancellation will normally apply to future service periods and will not automatically result in a refund for:

  • A service period that has already started.
  • Work already performed.
  • Resources already assigned.
  • Data, reports, campaigns or deliverables already supplied.
  • Third-party costs already incurred.

Pacific DataBytes will stop future renewals after accepting the cancellation request, subject to the applicable contractual notice period.

11. Situations Generally Not Eligible for a Refund

A refund will generally not be approved where:

  • The service was delivered according to the written specifications.
  • The client changes its mind after customized work has started or been delivered.
  • The client changes the targeting criteria after approving the original requirements.
  • The client does not provide required content, access, approvals, instructions or feedback.
  • Delays result from the client or a third-party provider.
  • A campaign does not achieve an expected response or conversion rate that was not contractually guaranteed.
  • Business information changes after it was researched, verified or delivered.
  • The data is modified, combined, resold, distributed or used outside the agreed licence.
  • Technical issues are caused by changes made by the client or another provider.
  • The service has been fully used, downloaded, accessed, deployed or consumed.
  • The request is unsupported by reasonable evidence.
  • The client breaches the applicable agreement or payment terms.
  • The requested work falls outside the agreed project scope.

This section does not limit any rights that cannot lawfully be excluded.

12. Refund Review Process

After receiving sufficient information, Pacific DataBytes will:

  1. Review the applicable proposal, agreement, order, invoice and project specifications.
  2. Examine the work completed and deliverables supplied.
  3. Review the evidence submitted by the client.
  4. Conduct an internal data, service or technical investigation where necessary.
  5. Determine whether correction, replacement, re-performance, credit, partial refund or full refund is appropriate.
  6. Communicate the decision to the client in writing.

The client may be asked to provide additional information where it is reasonably required to complete the investigation.

13. Approved Refunds

Approved refunds will normally be returned through the original payment method where possible.

  • Credit or debit card: The refund will ordinarily be issued to the card used for the original transaction.
  • Payment gateway: The refund will ordinarily be returned through the original payment account.
  • Bank transfer: The refund will ordinarily be sent to the verified bank account from which payment was received.
  • Another payment method: Pacific DataBytes will provide appropriate refund instructions.

The time required for an approved refund to appear in the client’s account may depend on the bank, card issuer, payment provider, currency and country involved.

Pacific DataBytes is not responsible for processing delays caused by a bank or payment provider after the refund has been issued.

14. Currency Conversion and Transaction Charges

For international transactions, the final amount received by the client may be affected by:

  • Exchange-rate changes.
  • Bank charges.
  • Card-provider charges.
  • Payment-gateway charges.
  • Intermediary bank fees.
  • Taxes or regulatory deductions.

Unless required by law or otherwise agreed in writing, Pacific DataBytes will not be responsible for differences caused by exchange-rate fluctuations or charges imposed independently by banks and payment providers.

15. Chargebacks and Payment Disputes

Clients are encouraged to contact Pacific DataBytes before initiating a chargeback or external payment dispute.

This allows us to review the matter, examine the relevant service records and attempt to resolve the concern directly.

Initiating an unsupported chargeback does not cancel the client’s contractual payment obligations and may result in the suspension of active services while the dispute is investigated.

16. Policy Changes

Pacific DataBytes may update this Cancellation and Refund Policy to reflect changes in its services, business procedures, payment methods or legal obligations.

Any revised policy will be published on this page with an updated revision date.

Changes will not retroactively alter the terms of an existing signed agreement unless agreed by the parties or required by law.
